Trademark can be protected under 45 classes (i.e. sectors). Trademarks in India are divided into 45 different classes or sections. An example of a class is, say, IT, confectionaries, cosmetics etc. When one applies for registration, he needs to ensure that he’s registering under the correct class or section, as relevant to the business activities.

The trademark cannot be copied by someone under the same trademark class. However it may be used by someone under different trademark class.

One needs to register the trademark the moment brand gains traction, as it ensures that you are the sole owner of the brand. The reason behind making a faster entry into the trademark register is simple. If you do not register for the trade name or mark in time, someone else, with same business interest might do so in near future.

It is safer to register for trademark protection as soon as your business takes off successfully. Or you risk having to change your brand name altogether, which may have an impact on retaining your original customers.

Your trademark is valid indefinitely. However, you need to renew the trademark application every 10 years.

How to think logically?

 

logicl2The word logic is derived from a Greek word “Logos” meaning study reason or discourse.  Thinking logically means having justification for every possible reason for every step or decision you will make. Logical decision making is done the basis of facts with suitable reasoning rather than emotions. It is the process of making strategies with logic and executing them on the based plan. It is a process of being smart and thinking creatively. You should justify your thoughts with logic and enlighten your team. You should justify the strategies, actions, and decisions based on the facts you gather. The logic can help you to get a better understanding of any problem or situation. The logic is the science and art of correct thinking. The reasoning is thinking, speaking about something in rational and logical ways. It involves thinking and a thorough analysis of the problem. Logical thinking focuses on the improvement in the analytical skills. Analytical skill helps to do a thorough analysis of any problem or situation.

Deductive reasoning is a crucial phase of the Logical thinking process. Now the question in your mind is what is deductive reasoning? Well, the answer is pretty simple.

Deductive reasoning involves a thought process in which general principles guide individuals as they analyze specific phenomenon or take specific action. Simply it can be said that follow a rulebook for any circumstances.

One example of deductive reasoning is ‘Human Resources have identified public speaking skills as an important qualifier for a particular position. They decide to require candidates to make an oral presentation on a predetermined topic as a part of their second interview.’

Abductive reasoning is the third form of logical reasoning and is somewhat similar to inductive reasoning. It was first introduced by the term “guessing” since conclusions are drawn here are based on probabilities. In abductive reasoning, it is presumed that the most plausible conclusion is also the correct one.

Unlike deductive and inductive reasoning, abductive reasoning is not commonly used for psychometric testing.

 

The logical thinking process involves taking the important ideas, facts, and conclusions involved in a problem and arranging them in a chain-like progression that takes on a meaning in and of it. To think logically is to think in steps. And justify your every step.

To be sound and logical Eckhart Tolle said “When you lose touch with your inner stillness, you lose touch within yourself you lose in the world. Your innermost sense of self, of who you are is inseparable from stillness. I am that is deeper than your name and form.”

Training in logical thinking encourages learners to think for themselves, to question hypotheses, to develop alternative hypotheses, and to test those hypotheses against known facts. That is how you decide what logically right solution is. You should consider all the aspects before you execute your plan. Comparing hypotheses or assumptions with the actual fact needs logical understanding.

It has been proven that specific training in logical thinking processes can make people “smarter.” Logical thinking allows a child to reject quick answers, such as “I don’t know,” or “this is too difficult,” by empowering them to involve deeper into their thinking processes and understand better the methods used to arrive at a solution and even the solution itself.

 

 

SPICE forms: A hassle-free process of incorporation

Ministry of Corporate Affairs (‘MCA’) has come with for Incorporation of Company under Companies Act, 2013 to incorporate the company within one day; with the SPICE forms meaning (Simplified Performa for Incorporating Company Electronically).

It was a significant step taken by Ministry of Corporate Affairs by introducing e-form INC-32 under SPICe scheme vides MCA’s notification dated 01/10/2016 notifying Companies (Incorporation) Fourth Amendment Rules, 2016.

The Ministry of corporate affairs (MCA) is primarily concerned with the administration of the Companies Act 2013, the Companies Act 1956, the Limited Liability Partnership Act, 2008 & other allied Acts and rules & regulations framed there-under mainly for regulating the functioning of the corporate sector in accordance with law.

The following forms are notified by MCA:

  • Incorporation of a company in e-Form SPICE (INC-32)
  • e-Memorandum of association in e-Form SPICE MOA (INC-33)
  • e-Article of association in e-Form in e-Form SPICE AOA (INC-34)

In today’s global scenario, it’s a very way to start the business with a single window form.

It’s said so because earlier if a Person wanted to incorporate Company then they had to apply for the DIN, Approval of the Name, its availability, separate form for first Director, Registered office address, PAN, TAN etc.

But this form can be used for all the following purposes:

  • Application of DIN (up to 3 Directors)
  • Application for Availability of Name
  • There is no need to file a separate form for first Director (DIR-12)
  • There is no need to file a separate form for an address of registered office (INC-22)
  • There is no need to file a separate form for PAN & TAN

Type of companies covered under e-Form SPICE (INC-32):

  1. One Person Company = INC-32 (SPICe )
  2. Private Limited Company (with7 or less than 7 subscribers) = INC-32 (SPICe )
  • Public Limited Company (with7 or less than 7 subscribers) = INC-32 (SPICe )

  2. Producer Company (with7 or less than 7 subscribers) = INC-32 (SPICe )

  • Company with foreign Subscribers (up to 7) = INC-32 (SPICe )

  • Maximum THREE (3) directors are allowed for filing application of allotment of DIN while incorporating a Company.
  • The person can also apply for the name in this form.
  • By affixation of DSC of the subscriber on the INC-33 (e-moa), date of signing will appear automatically by the form.
  • Applying for PAN / TAN will be compulsory for all fresh incorporation applications filed in the new version of the SPICe form.

  • PAN (as allotted by Income Tax Deptt) will be printed in the Certification of Incorporation, and TAN will be separately communicated to the stakeholders by email
  • The new version of SPICe form for all fresh incorporation applications w.e.f 01 Feb 2017

Leadership acts on people’s feelings, meaning a leader finds ways to link to people’s instinct or intuition. Leaders help everyone feel empowered, which in many organizations with bad histories is a leap of faith. If a leader can also provide concrete evidence that helps the empowerment, is wonderful. But evidence usually comes after the leadership actions produce the desired results.

Adaptation triggers long chains of further adaptations that ultimately solve seemingly impossible problems. Each approach works differently for everyone, but each type of leader has taken time to figure out their style.

Having the courage to do what you believe will work is sometimes one of the hardest things to do. With courage also come determination and patience – the ability to hold firm and not succumb to negativity or the pressure to crumble, and the patience to keep going along a difficult road until they reach the end with their head held high, no matter what the outcome. You should be dedicated in what you believe. A leader is supposed to motivate his followers in a positive direction with a healthy mindset. Always remember that Success is not final, failure is not fatal, it’s the courage to continue pushing that counts. Courage is not having the strength to go on it is going on when you don’t have the strength. Courage is very important factor in leadership. It’s the will to stand against the tide, when the wind is against you and you have to sail in the opposite direction. A leader inspires his people to do the same. Always remember that fear is a reaction and courage is a decision. A great leader knows it and execute when needed. It is always easy to stand in a crowd but it takes courage to stand alone. If you overcome that stage the crowd will follow you eventually.

A good leader will often command the attention of an entire room, sometimes without even speaking. This level of presence is not something you just possess from birth. It’s a quality that needs to be earned through the respect of your employees, working hard and being honest at every step of the journey. Presence is often the result of

humility in a leader. Acting aloof or superior to employees is likely to cause dislike and disruption, resulting in a negative environment. Instead, a good leader can listen to their employees, talk on their level and gain their trust. All these events can lead to the creation of an aurora of positivity.

A great leader is a strong motivator. Off course the past cannot be changed but the future is yet in your hand. A leader always aims for the moon, if he misses he may hit a star. What is Composition Scheme?

Automatic 2-way data integration using connectors: Very soon we will offer API enabled integration between all versions of Tally and SmartGST software.

You need to just download the API Utility. Once implemented, it will be reflected in Utilities as SmartGST integration.

The connectors will allow 2-way data integration between Tally and SmartGST software, i.e you will be able to push data to SmartGST platform from Tally at a click and import the data back to Tally from SmartGST platform.
